Terms and Conditions

In these Conditions the following words shall have the following meanings

 

The Buyer/You: The person(s), firm or Company who purchases the Goods from Steampunk Creative Engineering

The Company/I: Steampunk Creative Engineering (sole proprietor; Michael Hewitt)

Contract: Any Contract between the Company and the Buyer for the sale of the Goods, incorporating these Conditions.

Goods: Any goods agreed in the Contract to be supplied to the Buyer by the Company (including any part or parts of them)

Payment

Payment for goods can be made by one of the following payment methods:

  • Paypal
  • Credit cards
  • Debit cards
  • Cash, debit or credit card (on collection only)

Pricing

As a recently established small business, Steampunk Creative Engineering has not yet reached the threshold for VAT registration, consequently all prices stated are not liable for VAT.

Cancellation by me

I reserve the right to cancel the contract between us if, for example:

  • I do not have sufficient stock to deliver what you have ordered
  • I do not deliver to your area

If I do cancel your contract, I will notify you by e-mail and will refund to your account any sum deducted by me from your credit or debit card as soon as possible but in any event within 30 days of your order.

Cancellation by you

You may cancel the contract within 12 hours of placing your order by notifying me by email, text or phone. I will refund to your account any sum deducted by me from your credit or debit card as soon as possible but in any event within 30 days of your order.

Title and Risk

You will become the owner of the goods you have ordered when they have been delivered to you and I have received cleared funds in full payment for the goods. Once goods have been delivered to you they will be held at your own risk and I will not be liable for their loss or destruction.

Liability

I am not responsible if you cannot access the site properly or at all because of any event outside my control, for example (without limitation) the performance of your or my ISP, your browser or the internet.

This site relies in part on software to work. Whilst I will monitor the site, I cannot guarantee that the site or any individual feature of the site will be error free, available all the time and/or free from viruses. It is your responsibility to implement appropriate IT security safeguards (including anti-virus and other security checks) to satisfy your particular requirements as to the safety and reliability of content.

Guarantees and Warranties

All of my products are covered under my manufacturer’s warranty of one year against defective parts or workmanship.

Please note that due to the nature of some of the parts they are classed as consumables and are affected by use, care and fitting. Light bulbs are an example of items that fall into this category. These items may not be covered by any warranty period.

Faulty Goods

In the unlikely event that your goods arrive damaged or faulty, please contact me as soon as possible to arrange return and refund.

Custom Made Products

All of my custom-made products are non-returnable, unless faulty, as they are specially made to your specifications. If there is an issue with the product you should notify me immediately on 07722 049047

Shipping & Returns

Shipping

Delivery

For delivered orders, the cost of delivery is included in the price and dispatch will usually be next working day, allowing for my 12hr cancellation window.

Depending on size, I will normally use a Royal Mail or Parcel Force tracked service and I will notify the customer of the tracking number by email. I may use a courier at my discretion if there are service issues with these companies. I cannot guarantee delivery times when using postal services as they are outside my control. 

I may deliver personally, at my discretion, if the customer is reasonably local or the purchased item is difficult to package safely and effectively. In this event, I will establish a dialogue with the customer to deliver at a mutually agreed time.

All orders are subject to availability at all times. 
I will deliver the goods ordered by you to the address you give me for delivery at the time you make your order on the site. 
I am not responsible for any delay in delivery caused by the unavailability of someone to take delivery of the products. 
It is your responsibility to contact the post office or courier company as applicable to arrange the collection or delivery of products that could not be delivered because you were unavailable.

Packaging

My priority is getting the customer’s purchase to them undamaged and I will package all items well to withstand mistreatment. However, as an upcycler, my business is founded on sustainability and the principle of re-using things, to me, packaging is no exception. If I have suitable used packaging that is in good, clean condition I will normally dispatch items in re-used protective packaging.

Returns

To cancel and return an order, the Customer must return the goods at their own cost within 28 days; for non-defective goods Steampunk Creative Engineering will not refund this cost.  
The Customer is obliged to take reasonable care of the item and return it in good condition with the original packaging and accompanied by the original receipt. 
The Customer must notify me of return by e-mail or write to me within fourteen working days, starting the day after delivery of the item(s). 
The Customer is responsible for the goods until they are back in the possession of Steampunk Creative Engineering, the Customer must claim for any damages caused on the return, from the courier used. 
If the goods are not returned in good condition as received, then the right to a full refund is forfeited. The product packaging must also be returned in reasonably intact condition. 

When returning items that are deemed to be faulty, the Customer must contact Steampunk Creative Engineering prior to sending the articles back.

As per my Terms &Conditions, custom-made products are not refundable unless there is a problem with the product itself. All custom-made products are fully tested prior to leaving my workshop.

Steampunk Creative Engineering shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow care/safety instructions, misuse, alteration or repair of the goods (other than that done by Steampunk Creative Engineering).

This Privacy Policy describes how and when I collect, use, and share information when you purchase an item from me, contact me, or otherwise use my services through this website.

Information I Collect

To fulfil your order, it is necessary for you to provide me with certain information, such as your name, email address, postal address, payment information, and the details of the product that you’re ordering. You may also choose to provide me with additional personal information if you contact me directly, for example, for a custom order. 

Why I Need Your Information and How I Use It

I rely on a number of legal bases to collect, use, and share your information, including:

  • as needed to provide my services, such as when I use your information to fulfill your order, to settle disputes, or to provide customer support;
  • when you have provided your affirmative consent (which you may revoke at any time) such as by signing up for my mailing list.
  • if necessary, to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about your purchases if required by tax law.  
  • as necessary for the purpose of my legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as providing and improving my services - I use your information to provide the services you requested and in my legitimate interest to improve my services.

Information Sharing and Disclosure

Information about my customers is important to my business. I share your personal information for very limited reasons and in limited circumstances, as follows:

  • Service providers. I engage certain trusted third parties to perform functions and provide services to my shop, such as Royal Mail. I will share your personal information with these third parties, but only to the extent necessary to perform these services.
  • Business transfers. If I sell or merge my business, I may disclose your information as part of that transaction, only to the extent permitted by law. 
  • Compliance with laws. I may collect, use, retain, and share your information if I have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce my agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of my customers, or others.

Data Retention

I retain your personal information only for as long as necessary to provide you with my services and as described in my Privacy Policy. However, I may also be required to retain this information to comply with my legal and regulatory obligations, to resolve disputes, and to enforce my agreements. I generally keep your data for 6 years to comply with HMRC regulations. 

Transfers of Personal Information Outside the EU

I use iCloud to back up my iPhone and iPad so may store and process your information through third-party hosting services in the US and other jurisdictions. As a result, I may transfer your personal information to a jurisdiction with different data protection and government surveillance laws than your jurisdiction. If I am deemed to transfer information about you outside of the EU, I rely on iCloud’s encryption as the legal basis for the transfer, as all data is encrypted during storage and transfer.

Your Rights

If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. These rights are described below:

  • Access. You may have the right to access and receive a copy of the personal information I hold about you by contacting me using the contact information below. 
  • Change, restrict, delete. You may also have rights to change, restrict my use of, or delete your personal information. Except in exceptional circumstances (like where I am required to store data for legal reasons) I will generally delete your personal information upon request. 
  • Object. You can object to (a) my processing of some of your information based on my legitimate interests and (b) receiving marketing messages from me after providing your express consent to receive them. In such cases, I will delete your personal information unless I have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons. 
  • Complain. If you reside in the UK or EU and wish to raise a concern about my use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.
